Insurance Bad Faith

Insurance Contract Disputes

Insurance policies are considered contracts which are open to interpretation by the courts. As a policyholder, you may have a legal claim if your insurance company does not uphold their obligations under the contract. Insurance companies have a duty to treat their clients with good faith and fair dealing. If they do not follow those rules, however, you may not know what your rights are.

That is why working with an experienced lawyer can help. Brack & Westee, P.C. has handled insurance contract disputes in the State of Georgia and the greater Atlanta-metro area for over 20 years. Insurance bad faith cases are often quite complex, and we have handled them from start to finish. Call us at 770-884-1694 for a free consultation about your contract dispute.

What Is Insurance Bad Faith?

Occasionally an insurance company refuses to pay a valid claim. Under Georgia law, if an insurance company fails to properly settle your claim, denies your claim for an invalid reason or acts in bad faith, you can sue to recover the amount due on your insurance policy plus other damages for the insurance company's bad behavior.

It is possible to have a contract dispute with your insurance company or with the insurance company of another party.

Will You Know What To Do?

When you suffer a loss, you may not receive the coverage you expect. Or you may feel you have been offered an inadequate settlement or compensation. Before you accept a settlement, you will want to think about the estimated damages, both short and long term. You are not required to close the case immediately or accept the initial offer. You have the right to talk with an attorney about your options first.

It is no secret that insurance companies have lawyers working to protect their interests. Who will protect yours?
